NOTICE TO THE PUBLIC

 

Prior to President Benigno Simeon C. Aquino IIIs VERBAL pronouncements on Monday, 01 June 2015, business or mayor’s permit is authorized to be issued subject to post Fire Safety Inspection Certificate (FSIC) inspection under the Department of Interior and Local Government (“DILG”) and Department of Trade and Industry (“DTI”) Joint Memorandum Circular No. 1 Series of 2010, Joint Administrative Order No. 10-07, subsequent DILG Memorandum Circular No. 2011-05 issued by Secretary Jesse M. Robredo and BFP Memorandum dated 24 September 2012.

            Following the call of the DILG and DTI to streamline the Business Permits and Licensing System, the City of Valenzuela enacted Ordinance No. 62 Series of 2012 “An Ordinance Establishing the 3-S in Public Service Program in Valenzuela City and Providing Funds Therefor”. The main feature is the post-auditing arrangement, which warrants the post audit of the issued permits and clearances within a reasonable time to check compliance with other requirements, including sanitation permits, locational clearance and fire safety inspection permits.

            On Monday, 01 June 2015, President Aquino, has pronounced the government policy of “no FSIC, no business permits” and has in effect abandoned the Joint DILG-DTI Joint BPLS Streamlining Program as well as the policy circulars of Secretary Jesse Robredo, following the fire incident that transpired at Kentex Manufacturing Corporation on May 13, 2015,.

            On Tuesday, 02 June 2015, Secretary Manuel "Mar" Araneta Roxas II’s further reiterated President Aquino’s June 1, 2015 pronouncement during the Mayors’ Conference at Philippine National Police (PNP) Headquarters whereby, upon query by the undersigned Mayor, Secretary Mar Roxas replied that the policy now is No FSIC, No Business Permit and warned all mayors to take the risk arising from the issuance of business permits without the FSIC in cases of fire incidents in their areas of jurisdiction.

            In view of the foregoing pronouncements by the President and the DILG Secretary, the implementation of the June 1, 2015 directive of NO FSIC, NO BUSINESS PERMIT becomes urgent and mandatory under risk and pain of punitive legal repercussions all non-complying local chief executives will suffer in cases of fire incidents affecting business establishments without the required FSIC.

BY VIRTUE OF THE FOREGOING PREMISES, the City Mayor, by virtue of the powers vested in him by the Local Government Code & other pertinent laws and in his capacity as City Mayor, issued General Executive Order No. 2015-107, Series of 2015.

Now, HENCEFORTH, do hereby order the REVOCATION OF ALL BUSINESS PERMITS AND THE IMMEDIATE CLOSURE OF ALL BUSINESS ESTABLISHMENTS THAT DO NOT HAVE FIRE SAFETY INSPECTION CERTIFICATES (FSIC) PURSUANT TO THE PRESIDENTIAL PRONOUNCEMENT INSTITUTING THE NO FSIC, NO BUSINESS PERMIT POLICY. ANY RE-OPENING OF CLOSED BUSINESS ESTABLISHMENT SHALL BE SUBJECT TO THE PRESENTATION OF A VALID FSIC.

            ALL BUSINESS ESTABLISHMENTS ARE HEREBY REQUIRED TO PRESENT THEIR VALID FSIC WITHIN SEVEN (7) WORKING DAYS FROM RECEIPT OF THE GENERAL EXECUTIVE ORDER. OTHERWISE, THE IMMEDIATE REVOCATION AND CLOSURE OF THE BUSINESS ESTABLISHMENT IS HEREBY ORDERED WITHOUT NEED OF FURTHER NOTICE, EXECUTIVE AND/OR CLOSURE ORDER.

            FURTHER, NO NEW BUSINESS PERMIT OR RENEWAL THEREOF SHALL BE ISSUED UNLESS THE REQUIRED FSIC IS PRESENTED.
